Provisions passed as part of New York Governor Andrew Cuomo’s annual budget will make much-needed improvements to the state’s unemployment insurance (UI) program. Finally, New York’s maximum UI benefit, unchanged from $405 since 2000, will increase. This change is long overdue. Today, the state’s maximum benefit replaces just one-third of the state’s average paycheck; the average benefit of about $300 replaces just one-quarter, worse than in nearly every other state.

Yet another dangerous policy debacle, caused by Congressional stonewalling, is set to unleash large-scale across-the-board federal spending cuts – known as ‘sequestration’-- totaling $1.2 trillion over ten years. Most immediately, $85 billion of these senseless budget cuts for this fiscal year will trigger automatically on March 1. As a result, long-term unemployed workers receiving federal unemployment insurance will see their benefits reduced by 9.4 percent or more for the remainder of the fiscal year (through September 30, 2013), absent Congressional action. Large-scale cuts will also hit job-search assistance, reemployment services, and unemployment insurance administrative funds that are needed for claims and benefit processing.

Just one hour before midnight on New Year’s Day, the U.S. House of Representatives approved a one-year renewal of federally-funded Emergency Unemployment Compensation (EUC) as part of a year-end tax compromise which had passed the Senate some twenty hours earlier, and President Obama signed the measure yesterday. The reauthorization maintains the EUC program through December 31, 2013 as it was structured during the last four months of 2012. It neither adds nor reduces the maximum weeks of available EUC benefits for which states qualify depending on their three-month average unemployment rates.

Workers who are laid off after July 1 in Georgia will face the grim prospect of having their already-meager unemployment insurance benefits drastically curtailed. In the waning minutes of its 2012 session, Georgia’s state legislature last week approved a bill (HB 347) that slashes state unemployment insurance (UI) from the standard 26 weeks to a maximum of 20 weeks, and would further reduce the maximum to as few as 14 weeks depending on Georgia’s unemployment rate. That rate now stands at 9.1 percent, with Georgia tied for the seventh highest rate among the states. Fifty Georgia counties – nearly a third of the state’s total – had average unemployment rates of 12 percent or higher last year. The average duration of unemployment nationally is a near-record 40 weeks, but at most, future jobless workers in Georgia will only be able to receive half of those weeks in regular state benefits.

Overcoming efforts to dismantle federal unemployment insurance and undermine the basic UI system, Congress today approved a compromise payroll tax rate extension that also averts a threatened March 1st expiration of federal jobless benefits. Under the plan, the federal unemployment insurance program for long-term unemployed job-seekers who exhaust regular state benefits is continued, while maximum durations of benefits are reduced in stages over the remainder of 2012.

Having narrowly averted cutting off unemployment insurance to millions of Americans right before the holidays, Congress now returns to take up what should be a relatively simple task even for this Congress -- a full reauthorization of federal unemployment insurance, the payroll tax reduction and other provisions through 2012. But, as they did in December, some lawmakers are looking to revive House efforts to slash federal benefits, impose harsh new restrictions and move to dismantle the essential lifeline of unemployment insurance.

House leaders, acceding to mounting public outcry over their apparent willingness to cut off unemployment benefits to millions of unemployed job-seekers during the holiday season, agreed late Thursday to accept a compromise two-month extension. The bill passed the House and Senate early today and was promptly signed by President Obama. Along with continuing current provisions of federal unemployment insurance, the measure extends last year's payroll tax reduction, TANF aid for needy families and medical reimbursement rates for physicians serving Medicare patients. House and Senate leaders in both parties are appointing members to a conference committee, which will be tasked with reaching a year-long extension measure when they return after the holidays.

UPDATE: TUESDAY, DEC. 20 -- The National Employment Law Project (NELP) calls on the House of Representatives to hold a straight up-or-down vote on the Senate bill that extends federal unemployment insurance (UI) programs, along with the payroll tax holiday and “doc fix,” for the next two months. The Senate Leadership negotiated a bi-partisan compromise, with the involvement and blessing of the Speaker of the House. This compromise rebuffed attempts to scapegoat the unemployed and enact dangerous changes to the basic UI program which undermined its very purpose and effectiveness. While a two-month deal is not ideal, time is running out to protect the unemployed from being victims of the worst partisan games Congress has ever seen.
